Discusses the inability of the U.S. Department of Education's Office for Civil Rights (OCR) to deal with antisemitism on American campuses, as exemplified by events at the University of California at Irvine in 2003-04. Jewish students' complaints about physical and verbal harassment were met with relative indifference by the university administration and the case was brought before the OCR in California. However, when asked to intervene in incidents that its local investigators in California had determined as violations of the Jewish students' rights, the OCR in Washington failed to prosecute a single case. Argues that this was due to unwillingness to treat Jews as a distinct group beyond considerations of religious following. Adhering closely to title IV of the Civil Rights Act passed in 1964, the OCR has generally declined to pursue antisemitism allegations because none of the pertinent statutes mentions religion. Argues that the political appointees in Washington, who overruled the Californian OCR's career officials' conclusion that the case involved antisemitism, were also partly motivated by antisemitism. Concludes that the handling of this case indicates the existence of antisemitism on the highest levels of the civil rights administration.
