במשך שבעת השבועות, שעברו מאז ההסכם שנעשה ביום 19 אפריל 1098, לא באו שני הצדדים לעמק השווה והריב ביניהם התלקח ביתר עוז. בעצם אנו חוזרים למצב שבמושב בית דין הראשון שביום 9 נובמבר 1097: אללבדי מצהיר שבתשלום של מאתיים דינר יצא ידי כל התחייבויותיו, ואילו יקותיאל פקיד-הסוחרים טוען, שתשלום זה הוא רק פיצוי זמני, עד יישובם הסופי של החשבונות. מן המסמך שלפנינו מתבהרות כמה עובדות, שהיו סתומות עד עתה. אללבדי, הסוחר מטריפולי, הניח את כל סחורותיו, שהביאן עמו מהודו ומתימן, וכנראה, גם את הסחורות שקנה במקום, במחסנו (בבית-הפקידות) של יקותיאל, פקיד-הסוחרים. הלה, על־-פי תפקידו כפקיד-הסוחרים, מכר בשבילו חלק מן הסחורות, אך עיכב את מסירת התשלומים לאללבדי וגם לא נתן לו להוציא את סחורותיו. ביוני 1098, שבעה חודשים לאחר הישיבה הראשונה של בית הדין, חשבונותיו של אללבדי עדיין היו מונחים תחת סלי האינדיגו במחסנו של יקותיאל. אללבדי כבר התכונן לעשות מעשה ייאוש ולצעוק ברבים חמס על פקיד-הסוחרים על־-ידי עיכוב תפילת הציבור, אך, כפי שאנו רואים, העדיף להמשיך במשפט. הנתונים מבוססים על מידע מגויטיין, שלמה דב פרידמן, מרדכי עקיבא, ספר הודו א': יוסף אללבדי סוחר-הודו הגדול Cambridge University Library Cambridge England Ms. T-S 10 J 27.4 The Friedberg Genizah Project (FGP) 12917102 |
